Terms of Service for JumpSeat

1. Acceptance of Terms

By downloading, installing, accessing, or using the JumpSeat App (version 2.0.0 or later), you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using the App.

We reserve the right to update, change, or replace any part of these Terms at any time. It is your responsibility to check this page periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.

2. Description of Service

JumpSeat is a crowdsourced flight intelligence application that allows pilots and aviation enthusiasts to share and view real-time information about airports, airspace, and flight conditions. The Service includes:

• Real-time reporting - Submit and view reports about airports, airspace, and flight conditions
• User interactions - Vote on reports, add comments, and confirm report accuracy
• Map integration - View reports and airports on an interactive map
• Filtering and search - Filter reports by category, time range, airport, and status
• Real-time synchronization - Live updates as new reports are submitted
• Other features as may be added from time to time

3. User Accounts and Registration

To use the Service, you must create an account using email-based authentication:

• Email authentication - Accounts are created via magic link email authentication
• Accurate information - You agree to provide accurate, current, and complete information during registration
• Account security - You are responsible for maintaining the security of your email account
• Account responsibility - You accept responsibility for all activities that occur under your account
• Unauthorized access - You must notify us immediately of any unauthorized use of your account

Age Requirement: You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

Account Access: Access to your account is managed through email-based magic link authentication. You are responsible for maintaining access to the email address associated with your account.

4. User Conduct and Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• False information - Submit false, misleading, inaccurate, or outdated information
• Safety concerns - Submit information that could endanger the safety of pilots, passengers, or aircraft
• Legal compliance - Violate any applicable laws or regulations, including aviation regulations
• Rights infringement - Infringe upon the rights of others, including intellectual property rights
• Harassment - Harass, threaten, intimidate, or harm other users
• Unauthorized access - Attempt to gain unauthorized access to the Service or its related systems
• Malicious code - Use the Service to transmit viruses, malware, or other harmful code
• Service disruption - Interfere with or disrupt the Service or servers connected to the Service
• Automated access - Use automated systems to access the Service without our express written permission
• Impersonation - Impersonate any person or entity or misrepresent your affiliation

Aviation Safety: Given the critical nature of aviation information, you must exercise extreme care when submitting reports. False or misleading information could have serious safety consequences.

5. User-Generated Content

You retain ownership of any content you submit, post, or display on or through the Service ("User Content"), including reports, comments, votes, and confirmations. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in connection with the Service.

You represent and warrant that:

• Ownership - You own or have the necessary rights to submit the User Content
• No violations - The User Content does not violate any third-party rights, including intellectual property rights
• Accuracy - The User Content is accurate and not misleading to the best of your knowledge
• Legal compliance - The User Content complies with all applicable laws and regulations
• Safety - The User Content does not endanger aviation safety

Public Content: User Content you submit (reports, comments) is publicly visible to other users of the Service. Your email address and account information remain private.

We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, inappropriate, or potentially dangerous.

6. Location Services

The Service requires location permissions to:

• Display reports and airports on the map
• Enable location-based reporting
• Provide location context for user-generated content

By using the Service, you consent to the collection and use of location data as described in our Privacy Policy. You can disable location services in your device settings, though this will limit certain app functionality.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service is free of viruses or other harmful components

CRITICAL AVIATION DISCLAIMER: Information provided through the Service is crowdsourced and may not be accurate, complete, or up-to-date. YOU SHOULD NOT RELY SOLELY ON INFORMATION FROM THE SERVICE FOR FLIGHT PLANNING OR OPERATIONAL DECISIONS. Always verify information through official sources (NOTAMs, official airport information, ATC) and exercise appropriate caution. The Service is intended to supplement, not replace, official aviation information sources.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JUMPSEAT, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JUMPSEAT ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE OR RELIANCE ON USER-GENERATED CONTENT; ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN; ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; OR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE SERVICE.

AVIATION LIABILITY DISCLAIMER: Given the safety-critical nature of aviation, JumpSeat specifically disclaims any liability for decisions made based on information provided through the Service. Users are solely responsible for verifying all information through official sources before making flight planning or operational decisions.

This limitation of liability applies regardless of the legal theory on which the claim is based, including contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to defend, indemnify, and hold harmless JumpSeat, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service
• Your User Content
• Your reliance on information from the Service
• Any use of the Service's content other than as expressly authorized in these Terms

10. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of JumpSeat and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may contact us at support@jseat.app to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
